Defendant appealed the decision of the trial judge sustaining the violation of R.I.G.L. 1956 § 31-16-5 (turn signal required). The Court held that because there was insufficient evidence on the record to sustain the charge against the defendant and that the trial judge mischaracterized the testimony at trial, the decision to sustain the charge was clearly erroneous.
