Right to Appeal

The state appealed a decision of the Appeals Panel affirming the dismissal of a violation of R.I.G.L. 1956 § 31-27-2.1 (refusal to submit to a chemical test). The District Court held that it did not posses the authority to hear the appeal because the state filed for appeal outside of the ten-day statutory appeals period and did not file for an extension.  Accordingly, the Court affirmed the decision of the Appeals Panel.
