Craig Huntley v. State of Rhode Island, A.A. No. 2010-0157 Arrest

Defendant appealed the decision of the Appeals Panel sustaining the violation of R.I.G.L. 1956 § 31-27-2.1 (refusal to submit). Defendant argued that the decision of the Appeals Panel sustaining the violation was in error because he was not under arrest at the time he was read the “Rights for Use at the Station/Hospital.” The Court held that the defendant was read the “Rights for Use at the Station/Hospital” after he had been arrested because he had been turned over to the police by the medical personnel and the officers considered the defendant to be under their control. Accordingly, the Court sustained the violation against the defendant.
