Town of West Greenwich v. John Kornlieff, A.A. No. 2010-0188 Hearsay

Defendant appealed the decision of the Appeals Panel sustaining the violations of R.I.G.L. 1956 § 31-15-8 (no passing zones) and R.I.G.L 1956 § 31-15-12 (interval between vehicle). Defendant argued that the decision of the trial judge was clearly erroneous because she improperly admitted hearsay testimony. The District Court held that the issue was not properly preserved for appeal because the defendant failed to object at trial. Accordingly, the Court sustained the violation against the defendant.
