Credibility

Defendant appealed the decision of the North Providence Municipal Court sustaining the violation of R.I.G.L. 1956 § 31-20-09 (obedience to stop signs). The defendant claimed that the trial judge was clearly erroneous in crediting the officer’s testimony over his and his wife’s testimony. However, the Court held that only the finder of fact may assess the credibility of witnesses. Due Process

Defendant appealed the decision of the North Providence Municipal Court sustaining the violation of R.I.G.L. 1956 § 31-20-09 (obedience to stop signs). The Court held that the fact that the citing officer mistakenly wrote on the citation that the defendant was the owner of the vehicle did not rise to the level of a procedural due process violation.
